These Terms of Service (“Terms”) govern your access to and use of the Scoundrel: The Descent website located at https://www.scoundrelcardgame.com, the mobile game, and related services (together, the “Services”) provided by Scoundrel (“we,” “us,” or “our”). By downloading, installing, accessing, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Eligibility and Account Responsibilities
- You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. Certain regions may require a higher minimum age for mobile app usage.
- If you are between 13 and 18, you must have a parent or legal guardian review these Terms and consent to your use of the Services.
- You are responsible for maintaining the security of your device, platform credentials, and any login information associated with your use of the Services.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the game for personal, non-commercial entertainment purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit the Services except as expressly permitted by these Terms or applicable law.
User Conduct
You agree that you will not:
- Use the Services for any unlawful, misleading, fraudulent, or harmful purpose.
- Attempt to gain unauthorized access to the Services or interfere with their operation, including through cheating, automation, or exploiting bugs.
- Upload, transmit, or distribute viruses, malware, or other harmful code.
- Harass, threaten, or abuse other users or our team through any communications channels we provide.
Virtual Items and In-App Purchases
The Services may offer virtual currency, cosmetic items, or other digital goods for purchase. Virtual items have no real-world monetary value, are non-transferable, and are provided under a limited license that ends when these Terms terminate. All purchases made through app store platforms are final, subject to the platform’s refund policies. We may modify, suspend, or discontinue the availability of virtual items at any time without liability.
Feedback
If you choose to provide feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
Ownership and Intellectual Property
All content, artwork, gameplay systems, trademarks, logos, and other materials within the Services are owned by Scoundrel or our licensors and are protected by intellectual property laws. The underlying game design of Scoundrel was created by Zach Gage and Kurt Bieg in 2011; Scoundrel: The Descent is an independent digital adaptation and is not affiliated with or endorsed by the original creators. Except for the limited license granted to you, no rights are transferred or licensed to you by implication or otherwise.
Third-Party Services
The Services may rely on third-party platforms or include links to third-party websites, communities, or social media. We are not responsible for the content, policies, or practices of any third-party services. Your use of those services is subject to their separate terms and privacy policies.
Updates and Availability
We may release patches, updates, or new versions of the Services that are required for continued use. We may also modify or discontinue the Services, including particular features or content, at any time. We are not responsible for any failure to access the Services caused by factors outside our reasonable control, such as outages, maintenance, or the actions of platform providers.
Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or for any other reason permitted by law. You may stop using the Services at any time. Sections of these Terms that by their nature should survive termination will remain in effect, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution.
Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, Scoundrel and its affiliates, developers, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising out of your use of or inability to use the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us in the six months preceding the claim or one hundred (100) USD, whichever is greater.
Indemnification
You agree to defend, indemnify, and hold harmless Scoundrel, our affiliates, and our respective employees, contractors, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms or misuse of the Services.
Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. If the laws of your jurisdiction require a different governing law or venue for consumer contracts, the required rights remain unaffected. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in King County, Washington, and you consent to the jurisdiction of those courts.
Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and any additional terms we provide for specific features, constitute the entire agreement between you and Scoundrel regarding the Services.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the effective date above and, where required, provide additional notice. By continuing to access or use the Services after the revisions take effect, you agree to be bound by the updated Terms.
